Terms and Conditions (‘Terms’)

1. Website operator
This website, https://buenaventuralaw.com.au (“Website”), is operated under the registered business name Buenaventura Law, ABN 34 847 747 706 (“Buenaventura Law”, “we”, “us” or “our”). By accessing or using the Website, you agree to these Terms. If you do not agree, you must not use the Website.
2. General information only
The Website provides general information about Buenaventura Law and legal topics. Its content:
• is general information only and is not legal advice;
• may not be complete, current or applicable to your circumstances; and
• must not be relied upon when making a legal or commercial decision.
No representation or warranty is made that Website content is accurate, complete, current or suitable for a particular purpose.
3. No solicitor-client relationship
Accessing the Website, submitting an online form, sending an email or receiving a response does not create a solicitor-client relationship or mean that Buenaventura Law has accepted instructions.
Buenaventura Law acts only after:
1. completing any required conflict, identity and risk checks;
2. agreeing in writing to accept the engagement; and
3. issuing or confirming the applicable engagement and costs documents.
Until then, Buenaventura Law has no obligation to act, protect your interests or monitor any deadline.
4. Enquiries and confidential information
Do not send confidential, sensitive, privileged or time-critical information through the Website before Buenaventura Law confirms in writing that it has accepted the engagement.
Online enquiries may not be received or reviewed immediately. Sending information through the Website:
• does not constitute formal instructions;
• does not reserve Buenaventura Law’s availability;
• does not prevent the firm from acting for another person; and
• does not constitute service of a document or legal process.
You remain responsible for identifying and complying with all limitation periods, filing dates, court dates and other deadlines unless Buenaventura Law has expressly accepted responsibility for them in writing.
5. Conflict checks and legal compliance
Buenaventura Law may require information to undertake conflict checks, verify identity and authority, assess risk, and comply with legal and professional obligations.
Where applicable, this may include customer due diligence under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth). Buenaventura Law may decline, suspend or terminate services if requested information is not provided or cannot be satisfactorily verified, or where required or permitted by law or professional obligations.
6. Legal services and costs
Any legal services are governed by the written costs disclosure, costs agreement, engagement letter and other retainer terms issued for the matter. If those documents conflict with these Terms, the matter-specific documents prevail in relation to the legal services.
Nothing on the Website guarantees that Buenaventura Law will accept a matter, provide a particular service, charge a particular fee or achieve a particular outcome.
7. Permitted use and intellectual property
Unless otherwise stated, Website content is owned by or licensed to Buenaventura Law.
You may view or print Website content for personal, non-commercial reference. You must not, without prior written permission:
• reproduce, republish, modify, distribute or commercially exploit Website content;
• use Buenaventura Law’s name, logo or branding;
• scrape or harvest Website content or data;
• use Website content to train an artificial-intelligence system; or
• interfere with the Website’s operation or security.
You must not use the Website unlawfully, fraudulently or in a way that infringes another person’s rights.

Buenaventura Law does not guarantee that the Website will be uninterrupted, secure or free from errors, viruses or other harmful components.
Electronic communications may be delayed, intercepted, corrupted or misdirected. You must independently verify any request to transfer money or change payment details using a known telephone number before making payment.
Buenaventura Law may modify, suspend or discontinue any part of the Website without notice.
10. Privacy
Personal information collected through the Website is handled in accordance with our Privacy Policy and applicable law.
By submitting information, you confirm that you are authorised to provide it and that it is accurate to the best of your knowledge.
11. Liability
Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, including under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law.
Subject to those non-excludable rights, and to the maximum extent permitted by law, Buenaventura Law is not liable for loss arising from:
• reliance on general Website content;
• any error, omission or outdated information;
• Website interruption or technical failure;
• an online enquiry or communication not being received or reviewed;
• a third-party website or service;
• unauthorised access outside our reasonable control; or
• use of the Website contrary to these Terms.
Where liability for a service supplied through the Website cannot be excluded but may lawfully be limited, liability is limited, at our option, to supplying the service again or paying the reasonable cost of having it supplied again.
12. Changes to these Terms
We may update these Terms by publishing the revised version on the Website. The revised Terms apply from the stated effective date.
Changes to these Terms do not amend an existing written costs agreement or engagement agreement.
13. Governing law
These Terms are governed by the laws of Western Australia and applicable Commonwealth laws. You submit to the non-exclusive jurisdiction of the courts of Western Australia and courts hearing appeals from them.
