Key Information on Rental Law Reforms in Western Australia
If you are currently renting out a residential property in Western Australia or considering doing so, it’s important to be aware of the changes to the rental laws effective from 29 July 2024. Here’s what you need to know:
Updated Forms
From 29 July 2024, landlords must use the updated tenancy forms. Ensure that all your documentation is current to comply with the new regulations.
Important Changes to Note
Rent Increases
Rent increases will be limited to once every 12 months. This change aims to provide tenants with greater certainty and stability, allowing them to better plan their finances. It also aligns Western Australia’s policies with those of most other states.
Pet Permissions
Pets are generally allowed, but tenants will need the landlord’s permission. At the beginning of a tenancy, tenants and landlords should agree on any pets, detailing this in the tenancy agreement. During the tenancy, tenants must use Form 25 (pet request form) to request permission.
Minor Modifications
Tenants can now make minor modifications to their rental property to make it feel more like home, subject to landlord approval. There is a list of permissible modifications, and tenants must request permission using Form 26 (minor modification request form). Tenants may need to restore the property to its original condition at the end of the tenancy.
Commissioner’s Role
The Commissioner can independently decide on tenants’ requests to keep pets or make minor modifications. If a landlord refuses a request or sets conditions, they may need to seek approval from the Commissioner. Tenants can also appeal to the Commissioner if they disagree with a landlord’s decision.
