Skilled Visas

Skilled visa applications are a large part of Australian migration law, where those who have a professional qualification or skill can apply to migrate under a skilled visa application.

Buenaventura Law has helped many clients obtain skilled visas and successfully migrate to Australia. Currently, these are the available skilled visa classifications.

General Skilled Migration (189 & 190)

This Visa is perfect for invited workers, eligible New Zealand citizens, and British National (Overseas) passport holders with skills who need to live and work permanently anywhere in Australia.

Skilled Regional Visa (491)
This Visa allows you to live and work in a designated regional area of Australia for up to five years. After that, you may be eligible for permanent residence if you meet certain criteria.

GTI (Global Talent Independent)
GTI is an Australian points-based immigration program that allows highly skilled and talented individuals from around the world to live and work in Australia permanently. The program aims to attract top global talent to contribute to Australia’s economy and society.

Distinguished Talent Visa (858 & 124)
The Distinguished Talent Visa (858 & 124) allows highly talented and skilled individuals to permanently live and work in the country. This Visa is designed for people with exceptional abilities or skills in their field of expertise who can contribute to the Australian economy and society.

Employer Sponsored Visas

Sponsored Visas enable skilled professionals to migrate to Australia with already secured employment.

The employer-sponsored visa program is designed to help employers who cannot find suitable employees in Australia. The program allows employers from various industries to sponsor overseas employees to help them migrate and work in Australia. The employer must meet specific criteria to be eligible to sponsor an employee for an employer-sponsored visa.

ENS Visa (Employer Nomination Scheme) (186)
The ENS visa (Employer Nomination Scheme) (186) is a permanent work visa for skilled workers nominated by their employer. This Visa allows you to live and work in Australia indefinitely.

Skilled Employer-Sponsored Regional (Provisional) Visa (494)
The Skilled Employer-Sponsored Regional (Provisional) visa Subclass 494 is a provisional skilled visa that allows you to work in regional Australia. You must be sponsored by an eligible employer and nominated for a position that meets the requirements of the subclass 494 visa.

TSS (Temporary Skill Shortage Visa) (482) – Medium & Short Term
The TSS (Temporary Skill Shortage) visa is a temporary visa that allows skilled workers to live and work in Australia for up to four years. This Visa has two streams: the Medium-term stream and the Short-term stream.

Temporary Activity Visas (400, 403, 407 & 408)
The Australian Government offers a number of different types of visas that allow people to come to Australia temporarily for a specific purpose. The most common are the 400, 403, 407, and 408 visas.

Business Visas

The business visa migration program is a complex set of legislation requiring an experienced immigration lawyer to ensure your application meets the requirements and is ultimately successful.

This Visa allows you to live and work in Australia indefinitely, giving you the freedom to pursue your business goals without worrying about your visa status. Business Visa’s also allows you to bring your family to Australia, providing them with the same opportunities to live and work in Australia.

Business Innovation And Investment (Provisional) Visa (Subclass 188)
The Business Innovation and Investment (Provisional) visa (subclass 188) is part of the Business Innovation and Investment Programme.

Business Innovation And Investment (Permanent) Visa (Subclass 888)
The Business Innovation and Investment (Permanent) visa (subclass 888) is the second stage of the Business Innovation and Investment (Provisional) visa (subclass 188). You can apply for it after you have fulfilled the requirements of your provisional Visa.

Business Talent (Permanent) Visa (Subclass 132)
The Business Talent visa (subclass 132) is a permanent residence visa for business people nominated by an Australian state or territory government agency.

Partner & Family Visas

Australian Immigration law has provisions to assist family members, spouses, and partners migrate to Australia.

The Partner and Family Visa allow partners and directly related family members older than 18 years to migrate to Australia to work or study. These visas also have a pathway to citizenship.

Partner Migration Onshore (820 & 801)
Partner Migration Onshore (820 & 801) is a permanent visa for people who are in a relationship with an Australian citizen or permanent resident. This Visa allows you to live and work permanently in Australia with your partner.

Partner Migration Offshore (309 & 100)
The Partner Migration Offshore ( 309 and 100 ) visas are permanent residence visas for people who are married to or in a de facto relationship with an Australian citizen or permanent resident who lives outside Australia.

Contributory Parent Visas (804, 864, 884 & 8700 (173, 103 & 143)
A number of contributory parent visas are available to parents who wish to live in Australia with their children. These include the Contributory Parent (Temporary) visa (subclass 173), the Contributory Parent (Migrant) visa (subclass 143), the Contributory Aged Parent (Residence) visa (subclass 864), and many more.

Career Visas (836 & 116)
Two types of carer visas allow you to work in Australia: the 836 visa and the 116 visa. The 836 visa is for people who have been offered a job in Australia, while the 116 visa is for people who have been invited to apply for a job in Australia.

Education Visa

Australia has a range of educational visas which will allow overseas students to study in Australia for a period of time.

There are different types of Education Visas, each with its own requirements and benefits. To apply for an Education Visa, you must meet specific requirements.

Student Visas (Education & Migration Solutions) (500)
A student visa is a type of Visa that allows foreign students to study in Australia. The Australian student visa program is designed to encourage international students to come to Australia to study at Australian institutions. Student visas are temporary visas that allow international students to study full-time in Australia for the duration of their course.

Student Guardian Visa (590)
The Student Guardian Visa (590) is a visa for international students under 18 years of age who need a guardian in Australia. The Visa allows the student’s parent or another adult relative to live in Australia while the student studies.

Temporary Graduate Visa (485 & 476)
The Temporary Graduate Visa (subclass 485) is a visa for international students who have completed their studies in Australia. Subclass 476 is a similar visa but for students from specific countries. These visas allow you to temporarily live, work and study in Australia after finishing your studies.

Working Holiday Visa (417)
A Working Holiday Visa (417) in Australia is a visa that allows young people to live and work in the country for up to 12 months. The Visa will enable you to work in any industry and study for up to four months. This Visa is ideal for backpackers and gap year students who want to travel and work their way around Australia.

Work And Holiday Visa (462)
The Work and Holiday visa (462) is a temporary visa for young people who want to work and holiday in Australia for up to a year.
